Wisconsin Penalties for DUI/OWI
First DUI/OWI conviction =
- fine of at between $150 and $300 plus OWI surcharge of $355; and
- driver's license suspension for 6-9 months.
Second DUI/OWI conviction (within 10 years) =
- Mandatory jail sentence of at least 5 days with maximum of 6 months;
- fine of between $350 and $1,100 plus OWI surcharge of $355;
- installation of ignition interlock device (if second conviction within 5 years); and
- driver's license suspension for 12-18 months.
Third DUI/OWI conviction (anytime) =
- Mandatory jail sentence of at least 30 days with maximum of 1 year;
- fine of between $600 and $2,000 plus OWI surcharge of $355;
- installation of ignition interlock device; and
- driver's license suspension for 2-3 years.
Fourth DUI/OWI conviction (anytime) =
- Mandatory jail sentence of at least 60 days with maximum of 1 year;

- possible vehicle seizure; and
- driver's license suspension for 2-3 years.
