Texas DWI Penalties
First DWI conviction in Texas:
- Mandatory jail sentence of at least 72 hours up to 180 days
- Up to 12 month suspended license
- Up to $2,000 in fines
- Annual fees of up to $2,000 for 3 years to keep driver's license
Second DWI conviction in Texas within 10 years:
- 30 days-1 year in jail
- Up to $4,000 in fines
- 180 days-2 years suspended license

- Installation of ignition interlock device, if 2 or more DWI convictions within 5 years
Third DWI conviction:
- Prison sentence of 2-10 years
- Up to $10,000 in fines

Refusal to Take Breathalyzer Test:
- Suspended license for 180 days
