Minnesota Penalties for DWI/DUI

First-time DWI conviction =

  • Jail sentence of up to 90 days;
  • fine of up to $1000; and
  • driver's license suspension for 90 days.

DUI conviction with prior DWI conviction (within 10 years) or first DWI conviction w/ BAC > 0.20 =

  • Mandatory jail sentence of at least 30 days with maximum of 1 year;
  • fine of up to $3,000; and
  • driver's license suspension for 180 days if second conviction; suspension for 1 year if excessive BAC violation.

Third DWI conviction (within 10 years) =

  • Mandatory jail sentence of at least 30 days with maximum of 1 year;
  • fine of up to $3,000; and
  • driver's license suspension permanently; and
  • vehicle forfeiture.

Fourth and subsequent DWI conviction (within 10 years) =

  • Mandatory jail sentence of up to 180 days with maximum of 7 years;
  • fine of up to $14,000;
  • driver's license suspension for permanently; and
  • vehicle forfeiture.
