Texas Penalties for DUI

First-time DUI conviction =

  • Mandatory jail sentence of at least 72 hours up to six months;
  • fine of up to $2,000; and
  • driver's license suspension for 3 months to 1 year.

Second DUI Conviction (BAC between .08% and .099%):

  • Possible jail sentence of up to 30 days;
  • fine of at between $300 and $500; and
  • driver's license suspension for 6 months to 2 years.
