Texas Drunk Driving Penalties & Dallas DWI Law

Texas DWI laws apply to all drunk driving arrests and convictions in the state. If you were arrested for DWI in the Dallas-Forth Worth area, the following sentences guidelines will apply should you be found guilty. The exact sentence you receive will depend on the specifics of your case and the decisions of the judge or jury.

First DWI

  • Jail time: Not less than 72 hours, and no more than 6 months. Not less than 6 days if open container found in vehicle.
  • Fine: Not to exceed $2,000
  • License suspension: Up to 12 months
  • Community service: No less than 24 hours, up to 100 hours
  • Probation: In most cases, a judge will order probation of 1 to 2 years, including DWI/Alcohol education course, monthly fees, etc.
  • Driver's license reinstatement may bring annual fees of $2,000 for first 3 years
  • Ignition Interlock Device required

Second DWI (within 10 years)

Texas laws consider out-of-state DWI, DUI or OWI arrests in sentencing.

  • Jail time: Not less than 72 hours, up to 1 year
  • Fines: Not to exceed $4,000
  • License suspension: 180 days to 2 years
  • Community service: No less than 80 hours, up to 200 hours
  • Deep lung air device: Must be installed after release on bond and prior to court hearing

Third DWI

After receiving a third DUI within 10 years, any additional DWI charge will be considered a felony. The penalties for felony DWI are:

  • Jail time: Not less than 2 years, up to 10 years
  • Fines: Not to exceed $10,000
  • License suspension: Up to 2 years
  • Community service: No less than 160 hours, up to 600 hours

Intoxication Assault

Causing serious bodily harm to another individual while driving under the influence can bring about charges of Intoxication Assault. The penalties for a conviction are:

  • Jail time: Minimum 2 years, up to 10 years
  • Fine: Not to exceed $10,000
  • Community service: No less than 160 hours, up to 600 hours

Intoxication Manslaughter

Causing the death of another individual while driving intoxicated in a public place can bring charges of Intoxication Manslaughter. The penalties upon conviction are:

  • Jail time: Minimum 2 years, up to 20 years
  • Fines: Not to exceed $10,000
  • Community service: No less than 240 hours, up to 800 hours
