MythBusters Take On “Beating the Breath Test”

By Tiffany Sanders, ESQ.

The Mythbusters attempted to “beath the breathalyzer”, and failed. Popular methods tested included the use of breath mints, eating an onion, denture cream, secretion of pennies or a battery in the mouth, and mouthwash. Only the mouthwash had an impact on the breathalyzer reading, and its effect was to produce two wildly disparate readings.

However, there may be ways to challenge the breath test evidence collected against you during your DUI trial. If you’ve been charged, speak with a DUI attorney about your options.

Beating the Breath Test
Use a mini activated charcoal bag to beat the test. Put it in your mouth BEFORE you are pulled over and keep it there. Charcoal deactives alcohol and for this reason it is pumped into the stomach of a seriously drunk person to keep them from dieing of alcohol poisening.
The breath testers test the gaseous alcohol coming out of your mouth, presumingly from your blood in your lungs from the alveolar gaseous exchange. So if the gaseous alcohol is absorbed/inactivated into/by the charchol then the amount of gaseous alcochol in your breath is decreased and the breath test results will give an inaccurate finding.

Very informative. I think it would be still safe if you will not drink and drive.

I’m glad they did these so that (hopefully) at least a few people out there will avoid drinking before driving due to the knowledge that they’re not likely to beat the test; they shouldn’t anyway, but every reason not to helps. That being said, had these myths been confirmed (i.e., had they determined that it’s possible to beat the test), I’d have been incensed at them for showing it.
